I'm having such problem, when trying to use setcap inside VM:
# setcap cap_net_raw=pe ping 
unable to set CAP_SETFCAP effective capability: Operation not permitted

Where is the problem? Googling didn't helped me.
Host OS is gentoo with openvz-sources kernel:
# uname -a
Linux baby-mon 2.6.32-openvz-feoktistov.1 #5 SMP Tue Dec 6 10:40:52 MSK 2011 x86_64 Intel(R) Xeon(R) CPU E5620 @ 2.40GHz GenuineIntel GNU/Linux

Container is gentoo stage3.
