The attached patch moves the checking for /dev/vzctl after loading openvz modules. In case udev is used on the system, /dev/vzctl appears only after openvz modules are loaded, so this is wrong to check for /dev/vzctl presence before they are loaded.

I suggest you to also apply the first patch from the above bug and create vzctl-3.0.11-r1 ebuild, otherwise udev-enabled people (==everybody) are having problems with /dev/vzctl.
