All of my containers have the problem of "no more ptys" when I try to issue the screen command as a user, with root there is no problem.

I done some digging on google and found when I execute this command in the container "mount -t devpts /dev/ptmx /dev/pts" the problem disappears until the next reboot.

The kernel is 2.6.18-238.12.1.el5.028stab091.1 with the containers operating system being ubuntu 10.10

Is there anyway to fix this problem?

I managed to fix the problem by editing the /etc/fstab

Changed this line
none /dev/pts devpts rw 0 0

To this
devpts /dev/pts devpts defaults 0 0

Maybe you have reached limit? AFAIK default is 16. To see what is your limit, try this:
grep numpty /proc/user_beancounters

sudo chmod 4755 /usr/libexec/pt_chown
